These Terms of Use (hereinafter, the “Terms”) govern access to and use of the virtual assistant or chatbot (hereinafter, the “Assistant”) made available to users through the website and the WhatsApp messaging app. References to the Assistant include either of these channels. Please read these Terms carefully before using the Assistant.
1. IDENTIFICATION OF THE OWNER
STEPHOUSE STUDENTS, S.L.U., is a company with its registered office at Calle Villanueva 2B, Escalera 1, Planta SM, 28001 Madrid, with Tax Identification Number B84777465, registered in the Madrid Commercial Registry, Electronic Folio IRUS 1000435047979, Entry 1, Page M-836108 (hereinafter, “StepHouse”).
For any questions regarding the Assistant, these Terms, or the processing of personal data, users may contact privacy@stephouse.es.
2. PURPOSE AND SCOPE OF APPLICATION
The Assistant is an artificial intelligence (hereinafter also “AI”)-based customer service and support tool designed to provide information, answer questions, and guide users regarding Stephouse’s products, services, and procedures, as well as, when appropriate, refer the inquiry to a human agent.
The Assistant is for informational purposes only and does not allow users to purchase products or services or perform transactions, which must be processed through Stephouse’s official channels. Its functionalities are limited to those determined by Stephouse at any given time.
3. ACCEPTANCE OF THE TERMS AND CONDITIONS
Use of the Assistant implies full and unreserved acceptance of these Terms and Conditions, as well as the Privacy Policy referred to below. If the user does not agree with any of them, they must refrain from using the Assistant.
4. REQUIREMENTS FOR ACCESS AND USE
The user represents that he or she has the necessary legal capacity to use the Assistant in accordance with applicable regulations.
5. NATURE OF THE SERVICE: USE OF ARTIFICIAL INTELLIGENCE
In accordance with the transparency obligations set forth in Regulation (EU) 2024/1689, which establishes harmonized rules on artificial intelligence (AI Regulation), the user is expressly informed that they are interacting with an artificial intelligence system and not with a natural person, without prejudice to the possible human intervention described in section 7.
Interactions are not used to train the model, which is configured internally solely using Stephouse’s instructions and documentation.
6. LIMITATIONS AND ACCURACY OF RESPONSES
Stephouse strives to ensure that the information provided by the Assistant is useful and accurate, but cannot guarantee that the responses are always complete, accurate, or up-to-date: due to the very nature of AI, they may contain errors or inaccuracies. To help us improve, if any response is inaccurate or inappropriate, users may report it via privacy@stephouse.es.
The information and guidance provided by the Assistant are for informational and guidance purposes only; they are not intended to be decisive for decision-making and do not constitute professional, legal, financial, or any other type of advice. Therefore, they should be used with discretion and at the user’s own risk.
The Assistant’s responses do not create contractual obligations nor do they replace official information, contracts, or communications formalized through the designated channels; in the event of a discrepancy, Stephouse’s official documentation shall prevail.
7. HUMAN INTERVENTION
The Assistant’s support may combine automated responses and intervention by human agents:
• Agents at the Stephouse call center can join the conversation at any time and respond directly to the user.
• In certain cases, the Assistant may transfer or refer the conversation to a human agent.
• The user can request to speak with a human agent at any time.
8. PROTECTION OF PERSONAL DATA
When using the service, users are advised to share only the information necessary for their inquiry. Likewise, we recommend that you do not disclose special categories of data (such as health data), third-party data, or sensitive financial information (credit cards or bank accounts). If you provide third-party data in the context of your inquiry (particularly when making an inquiry on behalf of another person interested in Stephouse’s services), you must agree to inform that person of these Terms and Conditions.
If you provide personal data, the processing of the data provided through the Assistant is governed by Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD), and is detailed in Stephouse’s Privacy Policy available at www.stephouse.es.
• Data Controller: Stephouse.
• Purpose of processing: To contact users and manage and process their inquiries, as detailed in the website’s Privacy Policy.
• Legal basis: The processing of the user’s personal data for the described purpose is based on its necessity for the performance of a contract between the user and Stephouse, or for the implementation of precontractual measures at the user’s request.
• Recipients: No data transfers are planned.
• Retention. Conversations are stored for the duration of the relationship and, thereafter, for the established legal retention periods.
• Exercise of rights. Users may exercise their rights of access, rectification, erasure, objection, restriction of processing, and data portability, as well as withdraw their consent, by contacting privacy@stephouse.es. Users also have the right to file a complaint with the Spanish Data Protection Agency (www.aepd.es).
Furthermore, when users use WhatsApp, the processing includes their phone number, and communications are routed through WhatsApp’s infrastructure (WhatsApp Ireland Limited), in accordance with that provider’s terms and privacy policy. Stephouse does not control the processing carried out by WhatsApp on its own behalf. You can find more information in WhatsApp’s Privacy Policy.
9. PROPER USE OF THE ASSISTANT
The user agrees to use the Assistant lawfully and in accordance with these Terms, the law, and good faith. In particular, the user may not:
• Post, disseminate, or solicit content that is unlawful, offensive, defamatory, discriminatory, or that infringes on the rights of third parties.
• Attempt to manipulate, alter, or circumvent the operation of the Assistant or its security measures, including instructions intended to cause the system to behave in an unintended manner.
• Engage in automated or mass use, or any use that may damage, disable, overload, or impair the service (for example, systematic data extraction).
• Introduce programs, viruses, worms, Trojan horses, or any other malicious code that could damage Stephouse’s systems or those of third parties.
The user shall be liable for any damages Stephouse may suffer as a result of a breach of these Terms or applicable law.
10. INTELLECTUAL AND INDUSTRIAL PROPERTY
The Assistant and its associated elements (software, designs, trademarks, trade names, logos, and content) are owned by Stephouse or third parties and are protected by intellectual and industrial property laws. Access to the Assistant does not grant the user any rights to them beyond those necessary for their use in accordance with these Terms.
11. AVAILABILITY OF THE SERVICE
Stephouse does not guarantee the uninterrupted operation of the Assistant and reserves the right to suspend, modify, or discontinue it, in whole or in part and without prior notice, particularly for technical, security, or maintenance reasons.
12. LIMITATION OF LIABILITY
Stephouse shall not be liable, to the fullest extent permitted by applicable law, for any damages that may result from the improper use of the Assistant, nor for any interruptions, outages, or defects in telecommunications services that are not the responsibility of Stephouse or its contracted providers. It is the user’s responsibility to ensure an adequate Internet connection.
The foregoing is without prejudice to any liabilities that, in accordance with mandatory consumer and user regulations, cannot be excluded or limited.
13. MODIFICATION OF THE TERMS AND CONDITIONS
Stephouse may modify these Terms and Conditions at any time. Any modifications will take effect upon publication, and the current version will be available within the Assistant itself. Users are encouraged to review them periodically.
14. APPLICABLE LAW AND JURISDICTION
These Terms and Conditions are governed by Spanish law. When the user is a consumer, the courts and tribunals corresponding to the user’s place of residence in Spain shall have jurisdiction. In all other cases, the parties submit to the courts and tribunals of Madrid.
